Szpunar proposes examining access and the expression chatbots reuse

Maciej Szpunar delivered his opinion in Case C-250/25, Like Company v Google Ireland. The Hungarian publisher alleges that Gemini used its articles both for training models and for generating answers. The Advocate General recommends declaring the training questions inadmissible as hypothetical: there is no evidence of that use and, in his view, training a model is not an “online use” of press publications. As a subsidiary analysis, he suggests that the text-and-data-mining exception generally permits such training. [1]

For answers, he proposes examining how the article was accessed — including whether effective technical measures such as a paywall were circumvented — and whether its expression is recognisably reused to the point that the user need not consult the original. He thus distinguishes the way a story is told from the facts it reports. He also addresses making content available to the public where that expression systematically appears in answers. [1]

The provider could be liable where such uses are inherent in its business model or effective preventive measures are absent. The opinion is non-binding: it is neither a judgment nor a finding of infringement against Google. [1]

Why it matters: publishers, search engines and services that retrieve documents to generate answers — RAG systems — need to assess training, access and the content delivered to users separately.

2. Ibero-American countries agree to pursue an artificial intelligence alliance

COOPERATION · DATA · 3 NOVEMBER

A ministerial meeting in Madrid agreed to promote the Ibero-American Artificial Intelligence Alliance. The document will be submitted for adoption at the heads of state and government summit on 4–5 November, also in Madrid. The initiative combines access to quality data, models adapted to the region's languages, and cooperation on computing capacity. [2]

The proposed data space will be federated: each country will decide what to share and under which conditions. Existing initiatives such as ALIA will contribute; participation is voluntary and the agreement sets a cooperation agenda. For public bodies and businesses, the practical question is how cooperation becomes accessible resources with clear rules for the data. [2]

3. Bull and Schwarz Digits sign a memorandum to develop European AI infrastructure

INFRASTRUCTURE · DIGITAL SOVEREIGNTY · 3 NOVEMBER

France's Bull and Germany's Schwarz Digits signed a memorandum of understanding to combine supercomputing, cloud services and AI software. Schwarz Digits will contribute STACKIT, and Bull its industrial and technological capabilities. Plans include manufacturing servers in Angers and integrating BullSequana AI into STACKIT's offering. [3]

The partners target public bodies and regulated industries seeking to keep data, infrastructure and operations under European jurisdiction and control. This is a preliminary agreement: the announcement describes future developments. For customers, the concrete terms of access, operation and contracting will determine the value of those services. 4. Thomson Reuters increases legal revenue as the division's margin falls

LEGAL INDUSTRY · RESULTS · 3 NOVEMBER

Thomson Reuters reported quarterly revenue of $1.833 billion, up 10%. Legal Professionals generated $788 million. Its adjusted EBITDA margin, a measure of operating profitability, fell from 49% to 46.6%. The company highlights Westlaw and CoCounsel Legal's contribution to growth. [4]

Products with generative AI represented 34% of annualised contract value, compared with 24% a year earlier. During the earnings presentation, the chief financial officer cited restructuring severance, Noetica and higher model costs among the pressures on profitability. The contract metric measures those products' commercial presence, not the productivity gains customers achieve. [5]

5. AMD nearly doubles data-centre revenue and records the effect of share warrants

SEMICONDUCTORS · FINANCING · 3 NOVEMBER

AMD announced approximately $13.4 billion in quarterly revenue, up 45%. Data centres contributed $8.5 billion, growing 97%, driven by EPYC and Instinct. The accounting reconciliation records $1.097 billion for the change in the value of the liability associated with customer share warrants. [6]

Agreements with OpenAI and Meta include these rights to purchase shares, subject to purchase milestones, share-price targets and other conditions. The remeasurement is a non-cash charge; potential shareholder dilution depends on the conditions being met. The new development is the effect in the quarterly accounts: incentives in supply contracts also affect financial results. [6][7]

6. Apple expects higher memory costs to reduce its margins

DEVICES · COSTS · RESULTS RELEASED ON 2 NOVEMBER

Apple reported quarterly revenue of $114.5 billion and a gross margin of 47.9%. That margin includes a favourable effect of approximately one percentage point from tariff refunds. During the earnings presentation, management described unusually sharp increases in memory prices. [8][9]

The chief financial officer put expected gross margin for the December quarter at 45–46%, mainly because of higher memory costs and, partly, the rollout of Siri AI. This is a forecast. The case shows how hardware and computing requirements affect the profitability of devices and their associated services. [9]

Briefs

São Paulo blocks Meta terms for media represented by ANJ, Abert and Aner. According to Tudo Rádio, reporting the associations' statement of 3 November, an injunction suspends clauses planned for 20 November and prevents unauthorised use of their content for AI training, while protecting their accounts against retaliation. Protection covers the represented media and is provisional. [11][12]

Apple describes AI-agent risks in its annual report. The 10-K signed on 3 November discusses systems that can alter code, send communications or complete transactions beyond their permissions, with consequences that may be difficult to reverse. These are disclosed risks; the report does not establish that all those incidents have occurred. [10]

CrowdStrike agrees to buy Fiddler and Dreadnode. The announcements of 3 November envisage adding agent behaviour tracking and security testing to Falcon. Both transactions remain subject to closing; the integrated capabilities are announced for the fourth quarter of its fiscal year 2027. [13][14]

CNAS proposes barriers against agents seeking to persist outside human control. Its Sovereign Agents report, dated 3 November, recommends isolated testing, access controls and liability for those who release such agents. This is a policy proposal, not legislation. [15]

The signal in the noise

AI is also shaped by rights, contracts and accounts. Accessing information, obtaining computing capacity and delegating actions distribute control and costs. The useful question is which resource is obtained, with whose permission, and which financial or legal obligations accompany its use.

Spain

On 3 November, the Spanish Cabinet considered proposals to strengthen high-speed railway safety. They include an AI agent and a digital twin — a computer representation of the network — to anticipate scenarios and detect anomalies. These are planned measures. [16]

On the radar

- António Costa invites European leaders to Dublin on 13 November. The informal meeting will discuss AI with Mistral's Arthur Mensch and Geoffrey Hinton as guests. [17] - AMD expands availability of Ryzen AI Max PRO 400 systems. Its announcement mentions machines from HP, Lenovo, Framework and GMKtec for working with local models. This is manufacturer information. [6]
